Terms of service

1. General These General Terms and Conditions govern any and all transactions between you (the “Buyer”) and Kodi Professional Europe (the “Seller”) in relation to the online purchase of publications from the Kodi Professional website. Before placing your order, please read these General Terms and Conditions of Sale carefully. When you place an order by clicking on the button ‘Order’ on the website, you acknowledge that you have taken notice of these General Terms and Conditions of Sale of Kodi Professional and you unconditionally agree with them and accept them. You equally agree that any other terms and conditions are hereby explicitly excluded. The version of the General Terms and Conditions of Sale current at the time you place an order will govern the transaction in relation to those products. If any clause in these General Terms and Conditions should be held invalid or not enforceable, this shall have no effect on the other clauses. The products offered via the Kodi Professional website are not intended for commercial resale.

2. Ordering Process When you have found the desired product, you may add it to your basket without any commitment by clicking the button ‘Order’. You may review the contents of your basket any time by clicking the button ‘Check out’. You can remove products from your shopping cart by clicking ‘Delete’. If you wish to purchase the products in your basket, click the button ‘Send order’. Please fill in your data. Mandatory fields are marked with an *. By clicking the ‘Submit’ button you will complete the ordering process. The Seller will acknowledge receipt of your order by sending you an email.

3. Contract Conclusion. The Seller accepts your order for a product by sending you a email confirming this order and the estimated shipping date. If the product ordered is in stock and the Seller has received your payment on its account, you should receive your order within the time indicated which starts running upon receipt of your payment on Seller’s account.

4. Delivery of Goods. Standard Shipping by Post: it is estimated that your order should arrive within the time indicated in the Confirmation Email. Whilst the Seller will do everything he can to keep to any specified delivery periods these cannot always be guaranteed and as such the Seller will not be bound by them. In any event, the Seller shall not be liable for late deliveries for reasons outside of its control.

5. Prices, Taxes and Shipping Costs. The price of products which you order from the Kodi Professional website will be the price valid at the time you submit your order. The price is displayed on screen before you submit your order. Prices are shown in Euro and do not include value added tax. You accept that you will be responsible for paying any sales or other taxes, duties and charges levied on products in the country where the products are to be delivered to the extent the Seller has not already invoiced you for these. Products remain property of the Seller until receipt of full payment.

6. Payment We accept VISA, MasterCard.

7. Cancellation Rights / Returns If you are a consumer having purchased our product(s) for non professional purposes, you have the right to cancel your order without any motivation within 14 days after receipt of the product. You also have the right to cancel before the delivery of the products. In that case, you should return the item(s) by post at your own risk and at your own costs. You do not have the right to cancel the order if the product is used. You have to return the product in perfect condition and in the original packaging. The Seller is never responsible for any damage or loss of the product caused during the return.

8. Warranty At the moment of delivery you have to inspect the product(s) very carefully. In the event of damaged, wrongful or incomplete deliveries these shall have to be notified within 7 business days after the delivery of the products. Complaints received after this period shall be invalid and inadmissible. Please contact Kodi Professional at contact@kodi-store.eu in order to rectify the issue.

9. Liability Kodi Professional shall not be liable for any damage or loss suffered by the Buyer (including any indirect or consequential loss) and in any way related to the purchase of the products, except in the event of gross negligence or wilful default on behalf of Kodi Professional. Kodi Professional shall not be responsible for damage or loss resulting from circumstances beyond its reasonable control, including, but not limited to, strikes, fire, and interruption in the communication systems, etc. or not obtaining the products from its suppliers or third parties in a timely manner.

10. Intellectual Property Rights The publications that can be ordered on the Kodi Professional website as well as the content of the Kodi Professional website is protected by copyright, trademark and other intellectual property rights. All proprietary rights in the publications and the content and materials displayed on the Kodi Professional website shall at all times remain with Kodi Professional, its Members or their respective suppliers (as the case may be). The publications may not be reproduced in whole or in part, transferred by electronic or conventional means, modified, linked to or used for public or commercial purposes without the prior written consent of Kodi Professional.

11. Governing Law and Jurisdiction These General Terms and Conditions of Sale and contracts formed under them shall be governed by Romanian law. The place of jurisdiction shall be Bucharest (Romania).
